    Is Overseas Hosting bad

    Hi all

    I have just got an email from my client who has been conversing with her ex-web designer. She has just come up with a new one on me:

    HOSTINGCOMPANY is Irish which can give legal problems if you have difficulties
    with HOSTINGCOMPANY
    Has anyone else heard this or does someone have both hands on a wooden spoon in a large mixing bowl of something putrid?

    Any thoughts/feedback would be gratefully received.

    Firstly I'm not a lawyer so this is only my understanding.

    Usually when you purchase hosting you agree to their terms, their terms should say something like this entire agreement is covered by the laws of the UK or wherever they are based. Therefore any issues where you want to take them to court you would have to do it where they state.

    As with any host you should always have a backup of your data so you can easily swap to a new one should issues arise and if you agree to a one month contract then I would have thought you'd be safe enough.

    Procedurally, you will have little recourse, suing people outside of your state is difficult enough, doing it outside of your country is only worthwhile if the stakes are really, really large. Realistically, you should be setting yourself up so that if you do experience difficulty, you should just dump them and change.

    This approach would be about the best but wouldn't help if say, the hosting company somehow sold your information (or client information) or business idea onto someone else. Then you'd pretty much be out of luck.
