Our law firm has been advised that you are attempting to chill free speech by threatening posters with legal action for their posts. We wish to take this opportunity to remind you that these tactics will not be tolerated by either our firm or the State of California.
Several courts, including in California where your operation resides, have repeatedly upheld Sec. 425.16 of the Code of Civil Procedure, known as the anti-SLAPP provision. This provision clearly provides relief for anyone whose free speech is threatened by malicious prosecution designed to chill public participation. That relief includes the recovery of damages and attorney's fees.
It is apparent from the postings on this particular blog that a number of your clients have experienced less-than-satisfactory results, and that many of them have raised concerns regarding your operation. We reiterate their right to express that opinion.
If you wish to silence these posters, your efforts will not go unchallenged and you are likely to lose more than you hope to gain. We advise you to go about your business with honesty and integrity, and perhaps these complaints will not be so widespread.
