What are the chances of a class action lawsuit against search engines for their culpability involving click fraud, particularly enhance/dogpile?

They don't care about small enterprises and their ppc daily spending cap, just as long as they get their revenue. Can anyone recommend a good law firm, or is this a lost cause?
