It works. That's certain. The TOS could use some cleaning up, though. The grammar is not very refined and some of the sentences are actually fragments. Not much else one can criticize. Your work is made simple--a little rewriting and you're off to the races.

First thing to consider, as far as getting out there... How prepared are you for the flood? You're already getting hits, and your servers are working fine. Will they be just as responsive when your load is 10 000 hits per day? or 100 000? or 1 000 000? Get out there as far as you can reach, yes; but, be sure you can carry the load. If everyone is sending you pictures from their iPhone they are all in the 2 MB range, and even more. Hopefully they're downloading to their PC first or their phone bill is going to be a whopper. You need to be the one who makes all this happen seamlessly--and for everyone--to make this fly. Are you up for it?

I just want my website to get out there, before going out and getting unlimited bandwidth/disk-space, I just want to know that I will have users, I am finding it very difficult to get users that are returning, but then again, the website is less than a week old. I don't want it to get to the point where I have ads on my site, and I will try to avoid that as much as I can, but I don't know where to advertise it, etc. And I doubt it will get around by word of mouth, and what's the most reliable web-host for this sort of stuff? because at the moment im on a 100gb bandwidth account, but willing to upgrade as soon as start getting some users.

I think you have some limitation that will restrict the flood. My first recommendations would be
More than just a link url. probably place this code on your web page (and other variations)
Title and text etc.
probably the ability to create seperate folders (for users with several images)
Some ability to communicate with your users - (if you update, add features, you would benefit from being able to contact users with images on site.
There is a lot of software around that that you will be competing with.

If Optimising for google gives you a headache? - try optimising your Users
How does that translate to 1 000 000 users uploading 2 MB files all day?
What I meant was I will upgrade when the user and views count start picking up, at this rate doesn't look it will be using half of that 100gb
