I received a solictors letter this morning, a website is claiming copyright infringement over a "calculator" web page on one of my websites. They are demanding £4000 compensation (£300 for each month it has been up) or they say they will start legal proceedings against my comapny.

A year ago I built a website that had this calculator on it for mixing vaping liquid recipes. I got the idea from seeing the other companies calculator on their website. Their calculator did not work in mobiles, it was all written in javascript and so I thought I could make a calculator in php that would be a bit better. So I did get the idea from them, but proceeded to write my own php script to do all the various calculations. As I say, their calculator is written in javascript, that I cant even see in the source code. It is the same idea, but I have excuted the idea my own way in php all written by me.

So the actual back end stuff is all my own work. The calculation being done is common, as there is only one way to make this stuff, so surely they cant stop me making a similar calculator if I write the code for it myself, specially in an entirely different language.

The front end does look similar, as I put it in an html table that was actually same size as the table they use to present the calculator, but wording is different, it just looks similar because there is really only one way to present the data, in an html table as a form with input fields. They say that the table size is same and cell padding is same, so are saying that it is infringement and that I have just "ported" (dont know what that mean") their source code into php.

I did not use any of their calculating code though, as I say I wrote it myself in php from scratch...maybe they think I have just put the javascript in a php file, but that is not the case.

Anyway..I am scared, they are a big company, I am a little company and until Monday I cant get any legal advice, but feel that its not fair, the table layout is similar yes, but the actual workings, the calculating being done, is all my own work, I even have the original text notes I made to work out the various formulas for calculating the recipes.

What do you think from what I have said, does it sound like i am on shaky ground? Can I be sued for using a similar table layout to present the data? Now, it wasn't me who said that, "I think it's going to be a lot of fun"! It was Matt Cutts, the Google Spamfuhrer. See Matt's blog post dated 13 May. If Matt thinks it will be fun, then you can guarantee that SEO experts will not!

Matt is singing the same old song, "Up with quality content, and down with spammy links!" This is not good news for small webmasters, because only the "big boys" can afford to pay top writers to churn out lots of quality content. This is not good news for SEO professionals, whose job is to put websites at a higher position in serps than their content really deserves. Basically, an SEO expert's job is to cheat Google to get good serps, and Google is strangling the ways to cheat.

Don't expect to find magic tips to beat Google on SEO forums. Matt has made it clear that his team read these forums. They will counter any magic techniques that they hear about. Matt's team also read the Blackhat forums. If any packages to beat Google are advertised, you can bet that Google will buy them, reverse engineer them, discover their footprints, and counter them.

So what can you do, if you really need to cheat? Firstly, you have to develop your own unique method to beat Google. That will take considerable brains. Then you have to restrain yourself, and never, ever, boast about it. That will take considerable self-control. But employing an SEO expert will not work any longer.

The problem for me is that I can't really test it. Nobody is blocking me from any websites. Not at present.

But... We know that many governments are contemplating giving themselves the power to control our internet access. It may be worth our while to get used to these new freedom technologies.
