AUP for parsing SERP

Hey,
Got a question about the do's and dont's with respect to parsing SERP data either via screen scrape or API if available. I've looked through Yahoo/Google/Msn legal language (no where near throughly) and at least one was against automated queries. If thats a case how are things like some of the tools on SEO Chat.com (Index page count checker, etc) legal? If I wanted to write a similar tool what should I do with respect to my communication with the search engines to not piss anyone off (eg, are banners on the site allowed).

Those guys are probably using a API key. API keys are no longer available from Google, from what I hear.

So does that mean the policies governing API usage allow for it and the ones governing non-api search prohibit it?
