I live in Quebec, Canada. My friend has a Canadian Incorporated company called Secur-Vision. They have been using this name for 22 years and have been around for 50.
A local French company decided to call their product Sécur-Vision. Notice the accent on the e. Now my friend contested and the courts said since the product is not targeting the same market, incorporated in Quebec and will be doing business only in Quebec it's fine.
Sécur-Vision bought the .com before we did. Can we take it back?
I’ve read about these situations in the past and the rightful owner is usually the Inc. Has anyone encountered a similar dilemma?
