View Full Version : Domain name first and than trademark after a year???

Hi
Just curious I already have a domian name and i want to trademark the name after a year or so since I don't have money to spend for $355 right now. But what if my competitor or a hole trademark the name than legally can some get the trademark if even i own the domain name way before they do the trademark.

You need to talk to a lawyer, but a domain does not give you much, if any, legal protection. A trademark does give you some legal protection.

I have heard of trademark holders getting a domain away from someone that had it, but I have never heard of a domain owner getting a trademark from someone that has it... make sense?

It is always safer, first to Register your Trade Mark and then to avail the domain in your Registered TM. This way, no one can give you even a threat! Even if you abandon the domain name, your TM registrations vests with you, so that you can challenge any abusive users, if it lands in any criminal hands!

When you take a domain name, some other person can Register the TM to fight you or freighten you, if the Name is so popular or in demand. I know a small time webmaster lost a court case, on a not so important name because that happened to be a Trade Mark name of some one else.
