Default JavaScript not detecting

I am designing a site and I want to use a flash gallery that incorporates JavaScript. The JS is just a flash detection bit. The gallery will be set on page that is viewed via an AJAX tab set up.

On the right side under the Condos Tab, it gives an error saying it could not detect a flash player.

However if you access the Condo Tab page directly:
www.reefvillagebelize.com/2008/tab_condos.php
it does not give the error, but shows the gallery as it should.

I have tried placing the JS detection code into the header include file, the individual page, the condo Tab page and also the included gallery page. Still nothing works.

I have used this gallery before with no problems...

is there a way to bypass the detection? Is it advisable to assume people have a flash player in this day and age?

any ideas?

According to abode, flash player 7 and above is installed on 98.6% of PC's as of Sept, 2008.
So, detection might be overkill.

That is what I thought... So I went and removed the detection and still the gallery doesn't work? it just shows a line (think its the bottom border as defined by the style sheet.).

anyone able to look at the files and advise if something is looking for a confirmation from the JS detection?
