What are the risks of using phplist

I'm currently using constant contact for email marketing, but I hated the fact that they don't have an api solution. (they actually have one, but you need to sign document, fax it to them, and bla bla - NOT for Me.)

I tried also Icontact, but they got this annoying thing called 'segments'. that's the only way to separate contact. but again, if you use different listings, they will count one email address 3 time if it was register to 3 listings... weird!

I was sign up now to GetResponse.com after I received an email from someone how use them, but they operate outside of the US. at first, it didn't bother me, but once I signed up to the free account, there were tons of staff that didn't make any sense and pull me of this thing.


AND my question is:

Since I liked phplist so much, am I going to take any risk by using it?

I thought about:
- Can my email address be caught as spam just by sending lots of email using cron job?
- Did anybody face any other implication with phplist?
- Is their built in cron job really working?
