Default Copyright Violation???

I just finished talking with one of my clients. This client I have been working with for about 1 1/2 weeks. The scenario is this:

I am in the process of creating a site for him. He gave me the details for a banner he wanted to head his site. He sent me some pics that he wanted me to use in the banner. I put it all together and he loves it. It is currently on every page of his site acting as his logo or branding if you will.

He received an email today from another design firm (or person) that he interviewed before awarding me the job. She is saying that the banner I created is "too similar" to the example banner she created. I had my client send me the banner she created. Upon looking at the banner, I would say they are a similar idea but the design is completely different. I myself do not believe there is any relevancy that would support a case for copyright.

I know it is kind of hard to judge without seeing the banners but give me your best opinion if you would. If you would like to see the banners feel free to email me and I will forward them to you. I don't want to reveal the site at this time or place her banner here.

If what you are saying is true, then I would not fret.

Firstly, the "chick" will have to jump through hoops galore to even begin to legally take action regarding the banner copyright.

Dont sweat until your client gets a legitimate cease and desist.

I'd say you're fine.

If you've got the original layered/vector file for it (e.g. a PSD, an AI) and you can show that you came up with the idea on your own based on the info provided by the client, then there's nothing she can do about it.

Just give her a nice glass of whine, and when she gets too drunk, call the WAAAAAAAAAAAAAAAAAAAAAAAHHHHHHHHHHHHHmbulance. ;)
