Duplicate Sites

I recently obtained a new SEO client and he has an html site and a "Flash" version with sililar content. The problem is, the Flash version is not a 100% Flash site, it is more like an html site with embedded Flash. Will this create a duplicate content penalty? The url is http://www.kimmonssecurity.com/

Well as first this site could use a little redesign before anything else.
And about the duplicate content.. is the flash version realy needed. The only thing that is flash is the menu and having duplicate pages just for a single menu... I don't know... replacing the menue with a simple[*]<ul> based menue could do the job...

I was not hired for web design, just SEO, and I will only suggest redesign to the extent that it will improve SEO.

If all of the text is exactly the same, they are playing a dangerous game... One of them could go and you never know which one it's going to be...

Just add the flash version into the robots.txt as excluded files. Shouldn't take much to get those out of the index and not have to worry about the duplicate content.
