Default Google Algorithm given away by Google itself?

I am sure many of you are on top of the patents that Google puts out. so you must know about the algorithm patent which is publicly available....

You will notice that they go into detail of how they determine relevancy of a site.

My issue is that I am not sure if they are actually following the algorithms that they patent or is the patent application an OLD algo that they wanted SEO's to see to throw them off while they use an updated algorithm that hasn't yet been patented.

Most likely they are using a variation or updated version of the algorithm, not because they want to confuse everyone but because of the simple element called time.
The way uspto is, it takes over one year before the application is published (2 or more years before patent is granted). So even when you search in publication database and not in patent database, what you see is more than 1 year old and you know yourself that in this business 1 year ago is considerd ancient time.
The reason that they go in so much detail is that they do not want that their patent be challenged in court later on or other find a variation that it is not covered by their patent.

I know about the time variation and ho old the algo is, but what I am saying is that they may be making the algo even older by publishing and old one after it becomes old. Even though an algo is 1 year old it is still not hard to figure it out compared to the changes of today. But if they extend the amount of time between algos by patenting an algo after it became old then they are sending people off the right path.
