Duplicate Content

I would like to know what criteria does Google take into accout while judging a site as Duplicate?

Like if i have a site in a different domain (or a sub-domain) with the same template (design wise) and the earlier one and have say different titles, change in headings and some changes in the content in the body. Will it be regarded as a duplicate site and banned???

You can use the same template and web design, but to make sure a page is not considered a duplicate you really need to have at least a 25 percent difference between the pages.

I would make sure you have different file names, different titles, different meta tags, and a different amount of text that appears on the page.
