Default Forum liability

Hi,
I have a forum on my site at www.yeclaserve.com. There is a thread about a property development which the developers are not best pleased about. They have asked me to take it down and i declined. They have started talking about legal action, etc. Can I be held responsible for this? Can they take me to court. We are based in Spain.

Where's the thread in question?

And as a moderator/admin, you'd be responsible for the content of your board and the posts of its members.

I don't know how this plays out in Spain, but in Canada when you need to sue or deal with a civil suit, it takes place in the defendant's jurisdiction (in your case, rural Spain).

Well I've read it all, and frankly the odds of them suing you are millions to one against, firstly they need to prove 'damage', they have to be able to prove beyond doubt that potential buyers have read the forum article and have withdrawn from contractual obligation. Then they have to prove that they do indeed have Planning Permission. Forget it, keep posting.
