It's doubtful that such dispute would be successful, as Yahoo makes it clear that 1) there is no guarantee of inclusion, 2) that they reserve the right to place the listing, if approved, in the category of their choice, and 3) that the subsmission fee is non-refundable regardless of the result of their review.
