There are oher avenues for you to pursue against this site. eg the DMCA. We have had threads here on this. I am sure DMOZ will remove the site if the appropriate legal avenues are followed. DMOZ can not be the "judge" of these kinds of issues.
HOWEVER, I will raise your issue internally to see what happens.
